 TERMS OF SALE

14.       Your order

14.1.   All orders are subject to availability. We cannot guarantee that any product will be available at any given time.

14.2.   In certain circumstances beyond our reasonable control (e.g. where there has been a change in law), we may need to stop selling certain products. If this happens and it affects your order, we will notify you by email, cancel your order and provide you with a full refund (including any delivery costs) if payment has already been made.

14.3.   If you would like to make any changes to your order after you have submitted it, please contact Us as soon as possible and we will let you know if it is possible to change your order. Changes cannot be guaranteed, and may be subject to other terms and conditions (including time limits and any applicable fees).

14.4.   After you place your order, we will send you an acknowledgment email to let you know that we have received your order. This does not mean that your order has been accepted by us. Your order is an offer to buy products from Us on these terms.

14.5.   Acceptance of your order by Us takes place when an email is sent from Us (or our authorised agent) confirming that the goods have been dispatched, at which point a legally binding contract is formed between you and Us on these terms. We will send you a shipping confirmation email to let you know once your order has been dispatched.

14.6.   If we do not accept your order, or there has been a mistake regarding the pricing or description of the products, we will email you using the details you provided when you placed your order. We have the right to reject any order for any reason.

14.7.   If we are making any bespoke or personalised products for you which are based on measurements or other information you provide to us, you are responsible for ensuring that the information is correct.

14.8.   The contract for the supply of goods is completed in NSW, Australia.

15.       Product description

15.1.   Descriptions of our products are set out on our website.

15.2.   Please read the product description carefully. Pictures and images of the products or their packaging on our website are for illustration purposes only. Your products and their packaging may vary slightly from those pictures or images.

15.3.   From time to time, our brands refresh their products and the ingredients they use may change slightly. We aim to update our digital platforms with any changes as soon as we can, but you should check the product packaging for the most up-to-date ingredient list.

16.       Use of our products

16.1.   Unless otherwise previously agreed with Us in writing, Our products are supplied on the basis that you will use them for domestic and personal purposes only, and that you will not use our products for commercial, business or resale purposes.

16.2.   We reserve the right to reject or decline any orders or products purchased from Us if it is deemed that you are purchasing products at commercial quantities.

17.       Prices

17.1.   Prices for our products are set out on our website. All prices are in Australian dollars and include GST at the applicable rate but exclude delivery and shipping fees.

We will give you the option to re-confirm your order at the correct price or to cancel your order. If we are unable to contact you, we will treat the order as cancelled and notify you by email.

17.4.   We may review and vary the prices of products, delivery fees and other charges at any time by updating the prices shown on the Sites. Any updated pricing applies to orders placed after the change. By placing an order after a price change, you agree to be bound by the pricing then in effect.

17.5.   Title to the products passes to you on the later of delivery to you or payment in full, and risk in the products passes on delivery (see clause 20.4). Delivery is taken to occur when the products are delivered to the address you nominate (whether or not any person is present to accept delivery), when collected by you or your authorised representative, or when handed to your nominated carrier. Where you authorise the carrier or Us to leave the products unattended at the delivery address, delivery is deemed to occur at the time and place the products are left.

17.6.   Nothing in these Terms excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law. Subject to clause 23 and to the extent permitted by law, our aggregate liability arising in connection with the pricing of products, acceptance of orders, delivery or non-delivery will not exceed the price paid by you for the affected products.

17.7.   Any delivery dates or periods are estimates only. To the extent permitted by law, we are not liable for any delay in delivery or failure to deliver caused by events or circumstances beyond our reasonable control, including those described in clause 22.

17.8.   To the extent permitted by law, we are not liable for any loss of or damage to products occurring after delivery in accordance with clause 20.4(b). Damage occurring during transit prior to delivery will, at our option, be remedied by repair, replacement or refund upon your prompt notification under clause 20.3. Nothing in this clause limits your rights under the Australian Consumer Law.

23.1.   If we breach these terms or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By “foreseeable” we mean that, at the time the contract was made, it was either clear that such loss or damage would occur or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).

23.2.   Nothing in these terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow Us to exclude or limit.
